Do You Need A Bankruptcy Lawyer


You made have heard stories about filing your own bankruptcy papers, but you should consider having a bankruptcy lawyer to protect your interests. The lawyer is going to charge you upwards of two thousand dollars, but they will work for you in a bankruptcy filing. The lawyer sits down with you and enters all your debts with account numbers and addresses of creditors. The lawyer will take all your important information including where you work and what the income is from each job.

A bankruptcy lawyer will give you a list of everything needed before you can file for bankruptcy. The documents will include paycheck stubs, bank statements, credit report, background history, deeds to home, insurance declaration pages and any documents pertaining to 401K and pension plans. Filing for bankruptcy does take some time before you are even ready for the actual filing with the court. You will see the lawyer a minimum of four times before the lawyer files for the bankruptcy.

The bankruptcy lawyer will attend the meeting with you and the trustee as well as the meeting with the creditors. The lawyer represents you and will give you advice and tell you what to expect. Once you pay for one half or so of the lawyer fees upfront, you will be ready to file the bankruptcy papers. The lawyer figures out the best way for you to file. If you do not have to file chapter 7, the lawyer can figure out how much you would pay if you choose to file a chapter 13.

The lawyer does work for you and the small amount of money it costs for the lawyer is worth the money. The remainder of the bankruptcy lawyer fee for a chapter 13 is included in your monthly repayment plan including the costs of the trustee.
